Purpose of this Policy
Please read the following carefully to understand Quail’s views and practices regarding your personal data and how it will be treated.
Quail is the controller and is responsible for your personal data.

Changes to the Policy and your duty to inform Quail of changes
Quail keeps this Policy under regular review. This version was last updated on 20 November 2020. Any changes made to this Policy in the future will be posted on this page and, where appropriate, notified to you by email.
It is important that the personal data Quail holds about you is accurate and current. Please keep Quail informed if your personal data changes during the contractual relationship.
2. THE DATA QUAIL COLLECTS ABOUT YOU
Personal data, or personal information, means any information about an individual from which that person can be identified. It does not include data where the identity has been removed (anonymous data).
Quail may collect, use, store and transfer different kinds of personal data about you which have been grouped together as follows:
Quail also collects, uses and shares Aggregated Data such as statistical or demographic data for any purpose. Aggregated Data could be derived from your personal data but is not considered personal data in law as this data will not directly or indirectly reveal your identity. For example, Quail may aggregate your Usage Data to calculate the percentage of users accessing a specific website feature. However, if Quail combines or connects Aggregated Data with your personal data so that it can directly or indirectly identify you, Quail treats the combined data as personal data which will be used in accordance with this Policy.
Quail does not collect any Special Categories of Personal Data about you (this includes details about your race or ethnicity, religious or philosophical beliefs, sex life, sexual orientation, political opinions, trade union membership, information about your health, and genetic and biometric data). Nor does Quail collect any information about criminal convictions and offences.
If you fail to provide personal data
Where Quail needs to collect personal data by law, or under the terms of a contract it has with you, and you fail to provide that data when requested, Quail may not be able to perform the contract it has or is trying to enter into with you (for example, to provide you with goods or services). In this case, Quail may have to cancel a product or service you have with it but will notify you if this is the case at the time.
3. HOW IS YOUR PERSONAL DATA COLLECTED?
Quail uses different methods to collect data from and about you including through:
o apply for Quail’s products or services;
o create an account on the Website;
o subscribe to Quail’s service or publications;
o request marketing to be sent to you;
o enter a competition, promotion or survey; or
o give feedback or contact Quail.
4. WHERE QUAIL STORES YOUR PERSONAL DATA
The data that Quail collects from you may be transferred to, and stored at, a destination outside the European Economic Area (EEA). It may also be processed by staff operating outside the EEA who work for Quail or for one of its suppliers. Such staff maybe engaged in, among other things, the fulfilment of your order, the processing of your payment details and the provision of support services. By submitting your personal data, you agree to this transfer, storing or processing. Quail will take all steps reasonably necessary to ensure that your data is treated securely and in accordance with this Policy.
All information you provide to Quail is stored on the secure servers of its suppliers. Any payment transactions will be encrypted (using SSL technology). Where Quail has given you (or where you have chosen) a password which enables you to access certain parts of the Website, you are responsible for keeping this password confidential. Quail asks you not to share a password with anyone.
Unfortunately, the transmission of information via the internet is not completely secure. Although Quail will do its best to protect your personal data, it cannot guarantee the security of your data transmitted to the Website; any transmission is at your own risk. Once Quail has received your information, it will use strict procedures and security features to try to prevent unauthorised access.
5. HOW QUAIL USES YOUR PERSONAL DATA

Generally, Quail does not rely on consent as a legal basis for processing your personal data although it will get your consent before sending third party direct marketing communications to you via email or text message. You have the right to withdraw consent to marketing at any time by getting in contact.
If you are an existing customer, Quail will only contact you by electronic means with information about goods and services similar to those which were the subject of a previous sale to you.
Quail strives to provide you with choices regarding certain personal data uses, particularly around marketing and advertising. Quail may use your Identity Data, Contact Data, Technical Data, Usage Data and Profile Data to form a view on what it thinks you may want or need, or what may be of interest to you. This is how Quail decides which products, services and offers may be relevant for you.
You will receive marketing communications from Quail if you have requested information from Quail or purchased goods or services from it and you have not opted out of receiving that marketing.
Quail will get your express opt-in consent before it shares your personal data with any third party for marketing purposes.
You can ask Quail or third parties to stop sending you marketing messages at any time by logging into the Website and checking or unchecking relevant boxes to adjust your marketing preferences or by contacting Quail at any time.
Where you opt out of receiving these marketing messages, this will not apply to personal data provided to Quail as a result of a product/service purchase, warranty registration, product/service experience or other transactions.
A cookie is a small file of letters and numbers that Quail stores on your browser or the hard drive of your computer if you agree. Cookies contain information that is transferred to your computer’s hard drive.
Usage of a cookie is in no way linked to any personally identifiable information while on the Website. Once you close your browser, the cookie simply terminates. For instance, by setting a cookie on the Website you would not have to log in a password more than once, thereby saving time while on the Website. If you reject the cookie, you may not be able to use every function of the Website. Cookies can also enable Quail to track and target your interests to enhance your experience of the Website.
Change of purpose
Quail will only use your personal data for the purposes for which it collected it, unless it reasonably considers that it needs to use it for another reason and that reason is compatible with the original purpose. If you wish to get an explanation as to how the processing for the new purpose is compatible with the original purpose, please make contact.
If Quail needs to use your personal data for an unrelated purpose, it will notify you and explain the legal basis which allows it to do so.
Please note that Quail may process your personal data without your knowledge or consent, in compliance with the above rules, where this is required or permitted by law.
6. DISCLOSURES OF YOUR PERSONAL DATA
Quail may share your personal data with third parties to whom it may choose to sell, transfer or merge parts of its business or assets. Alternatively, Quail may seek to acquire other businesses or merge with them. If a change happens to Quail’s business, then the new owners may use your personal data in the same way as set out in this Policy.
In addition, Quail may share your personal data with third parties if it is under a duty to disclose or share your personal data in order to comply with any legal obligation, or in order to enforce or apply any of its Terms and Conditions and other agreements; or to protect the rights, property, or safety of Quail, its
customers, or others. This includes exchanging information with other companies and organisations for the purposes of fraud protection and credit risk reduction.
Quail requires all third parties to respect the security of your personal data and to treat it in accordance with the law. Quail does not allow its third-party service providers to use your personal data for their own purposes and only permit them to process your personal data for specified purposes and in accordance with its instructions.
7. DATA SECURITY
Quail has put in place appropriate security measures to prevent your personal data from being accidentally lost, used or accessed in an unauthorised way, altered or disclosed. In addition, Quail limits access to your personal data to those employees, agents, contractors and other third parties who have a business need to know. They will only process your personal data on Quail’s instructions and they are subject to a duty of confidentiality.
Quail has put in place procedures to deal with any suspected personal data breach and will notify you and any applicable regulator of a breach where it is are legally required to do so.
8. DATA RETENTION
Quail will only retain your personal data for as long as reasonably necessary to fulfil the purposes it collected it for, including for the purposes of satisfying any legal, regulatory, tax, accounting or reporting requirements. Quail may retain your personal data for a longer period in the event of a complaint or if it reasonably believes there is a prospect of litigation in respect to the contractual relationship.
To determine the appropriate retention period for personal data, Quail considers the amount, nature and sensitivity of the personal data, the potential risk of harm from unauthorised use or disclosure of your personal data, the purposes for which it process your personal data and whether it can achieve those purposes through other means, and the applicable legal, regulatory, tax, accounting or other requirements.
9. YOUR LEGAL RIGHTS
Under certain circumstances, you have rights under data protection laws in relation to your personal data. You may:
o if you want it to establish the data's accuracy;
o where its use of the data is unlawful but you do not want it to erase it;
o where you need it to hold the data even if it no longer require it as you need it to establish, exercise or defend legal claims; or
o you have objected to its use of your data but it needs to verify whether it has overriding legitimate grounds to use it;
You will not have to pay a fee to access your personal data (or to exercise any of the other rights). However, Quail may charge a reasonable fee if your request is clearly unfounded, repetitive or excessive. Alternatively, Quail could refuse to comply with your request in these circumstances.
Quail may need to request specific information from you to help it confirm your identity and ensure your right to access your personal data (or to exercise any of your other rights). This is a security measure to ensure that personal data is not disclosed to any person who has no right to receive it. Quail may also contact you to ask you for further information in relation to your request to speed up its response.
Quail tries to respond to all legitimate requests within one month. Occasionally it could take Quail longer than a month if your request is particularly complex or you have made a number of requests. In this case, Quail will notify you and keep you updated.
